You control whether optional integrations are connected.
Minute Momentum's coaching Services may require information relating to your health, fitness, nutrition, physical condition, or wellness.
We use this information primarily to:
provide and personalize coaching; establish appropriate training and nutrition recommendations; track progress; identify reported limitations; adjust programming; communicate with you regarding your plan; and administer programs such as the Momentum Guarantee.
Minute Momentum does not collect health-related information for the purpose of selling it to advertisers or data brokers.
Where applicable law requires separate consent before processing particular sensitive information, Minute Momentum will request that consent.
You should not provide medical information that is unnecessary for your coaching relationship.
We may receive personal information:
directly from you when you register, enroll, complete onboarding, fill out a check-in, communicate with us, upload information, track food or exercise, submit photographs, or otherwise use the Services;
automatically from the application, website, browser, or device;
from FitBudd and other service providers operating portions of the Services;
from payment processors regarding transaction status;
from wearable devices or connected services that you voluntarily authorize;
and from other sources when you specifically direct or authorize those sources to provide information to Minute Momentum.
Minute Momentum may use personal information to:
provide, operate, administer, and personalize coaching Services;
create and maintain your account;
develop your training, nutrition, habit, or accountability plan;
monitor and evaluate progress;
review check-ins and tracking information;
modify recommendations based on your feedback and progress;
communicate with you about your coaching;
provide customer support;
process enrollment, billing, payment status, refunds, or other transactions;
administer the Momentum Guarantee and evaluate eligibility where applicable;

protect the security and integrity of accounts and systems;
detect fraud, abuse, security incidents, or violations of our Terms;
comply with legal obligations;
establish, exercise, or defend legal rights;
and perform other purposes disclosed to you at the time information is collected.
Minute Momentum may use information you provide to develop recommendations and make coaching decisions.
For example, changes in body weight, workout performance, nutrition tracking, check-in responses, injuries, scheduling circumstances, or client feedback may result in adjustments to training, nutrition, activity, or accountability recommendations.
These are coaching decisions made in connection with the Services and are not intended to constitute automated decisions producing legal or similarly significant effects.
Progress photographs submitted through Minute Momentum may be stored and reviewed for coaching purposes, including evaluating changes over time and providing coaching feedback.
Submitting a progress photograph for coaching does not authorize Minute Momentum to publish that photograph or use it in advertising.
Public use of photographs, before-and-after images, likenesses, testimonials, videos, or transformations requires separate affirmative Media/Testimonial/Marketing Authorization.
Declining marketing authorization will not prevent a client from receiving coaching.
Minute Momentum will not treat ordinary acceptance of this Privacy Policy, acceptance of the Terms & Conditions, or participation in coaching as permission to publicly use your likeness or testimonial.
Where Minute Momentum wishes to publicly use identifiable:
photographs; before-and-after photographs; videos; audio; name; likeness; testimonials; progress information; transformation information; or similar client material,
Minute Momentum will seek separate affirmative authorization.
The scope of any such use will be governed by the separate authorization provided by the client.
Payments may be processed through third-party payment processors.
Those payment processors may collect your:
name; billing address; payment-card information; bank information where applicable; email; telephone number; and other information needed to process a transaction.
Minute Momentum generally receives information such as payment status, transaction amount, payment date, payment method type or limited payment-method information, and transaction identifiers rather than complete payment credentials.
Payment processors process information according to their own privacy notices and security practices.
Minute Momentum uses FitBudd technology to provide the MM mobile application and related coaching functionality.
Information submitted through the application may therefore be processed, transmitted, or stored using FitBudd systems.
FitBudd maintains its own privacy practices governing its platform and describes information it may collect through its applications and related services.
Minute Momentum uses FitBudd as a technology provider; FitBudd is not the provider of your Minute Momentum coaching.
Minute Momentum may provide personal information to third-party service providers when reasonably necessary for them to perform services on our behalf.
These may include providers of:
application technology; cloud hosting and data storage; payment processing; email and communication services; customer support; website hosting; analytics; cybersecurity and fraud prevention; accounting and bookkeeping; legal and professional services; and other business infrastructure.
We seek to limit disclosures to information reasonably necessary for the provider's function.
These providers may maintain their own privacy policies or contractual data-processing obligations.
Minute Momentum does not sell clients' health, fitness, nutrition, progress, check-in, or coaching information to advertisers or data brokers.
Minute Momentum also does not provide identifiable progress photographs or health/coaching records to advertisers for their independent marketing use merely because you use the Services.
A disclosure to a service provider operating the Services on Minute Momentum's behalf is not intended to constitute a sale of your personal information.
If Minute Momentum's practices materially change in a manner that requires notice or consent under applicable law, appropriate notice and consent will be provided before the new use where required.
Minute Momentum may use website analytics and advertising technologies to understand website traffic, measure advertising performance, and improve marketing.
Depending on the technology enabled, those tools may receive information such as:
IP address; browser/device information; referral source; pages viewed; website interactions; and advertising identifiers.
Minute Momentum does not intentionally provide clients' private coaching records, health information, nutrition logs, check-ins, progress photographs, or similar sensitive coaching information to advertising platforms for targeted advertising.
Where applicable law requires consent or an opt-out for advertising-related tracking, Minute Momentum will provide applicable controls.
Minute Momentum may use your contact information to send communications necessary to provide the Services, including:
account notices; onboarding messages; check-in reminders; coaching feedback; payment or billing notices; security communications; program information; and customer-service responses.
We may also send promotional communications where permitted by law.
You may unsubscribe from promotional email communications using an unsubscribe mechanism when provided or by contacting hello@minutemomentum.com.
Opting out of promotional communications will not prevent Minute Momentum from sending necessary transactional or coaching-related communications.
Promotional text messaging, where used, will be subject to applicable consent and opt-out requirements.
Minute Momentum may disclose information when reasonably necessary to:
comply with applicable law, regulation, subpoena, court order, or lawful governmental request;
respond to valid legal process;
protect the rights, property, security, or safety of Minute Momentum, a client, or another person;
investigate fraud, abuse, or security incidents;
enforce agreements;
or establish, exercise, or defend legal claims.
We will seek to limit such disclosures to information reasonably necessary under the circumstances.
If Minute Momentum is involved in a merger, acquisition, financing, reorganization, sale of assets, transfer of ownership, or similar business transaction, personal information may be disclosed to appropriate parties as part of evaluating or completing that transaction.
Any successor that receives personal information will be subject to applicable legal requirements regarding that information.
Sensitive client information will not be treated as an unrestricted commercial asset.
Minute Momentum may create information that has been aggregated or reasonably deidentified so that it is not reasonably linkable to a particular individual.
Such information may be used to understand trends, evaluate the Services, improve coaching systems, or for legitimate business analysis.
Where required by applicable law, Minute Momentum will take reasonable measures designed to prevent deidentified information from being associated with an identifiable individual and will not attempt to reidentify it except where permitted by law.
Minute Momentum seeks to collect information that is reasonably relevant to the purposes described in this Privacy Policy.
Clients should avoid submitting sensitive personal information that is not needed for coaching or administration of the Services.
FTC guidance for health and fitness applications recommends minimizing collection and retaining health information only where there is a legitimate need for it.
Minute Momentum retains personal information only for as long as reasonably necessary for the purposes for which it was collected and for legitimate legal and business purposes.
Retention may depend upon:
the length of the coaching relationship; whether your account remains active; the type and sensitivity of the information; legal, accounting, tax, or recordkeeping requirements; payment or transaction history; potential disputes; security requirements; and the capabilities and retention settings of third-party platforms.
When information is no longer reasonably necessary, Minute Momentum will seek to delete, anonymize, or otherwise appropriately dispose of it, subject to legal and operational requirements.
Backup copies may remain for a limited period after deletion until they are overwritten or removed through normal backup processes.
You may request deletion of your account and/or personal information by:
using an available account or data-deletion feature within the Minute Momentum/FitBudd application; or
contacting hello@minutemomentum.com.
Minute Momentum may need to verify your identity before processing a request.
Certain information may be retained when reasonably necessary or legally permitted, including information needed to:
comply with tax, accounting, payment, or other legal obligations;
establish or defend legal claims;
prevent fraud or abuse;
document transactions;
enforce agreements;
or maintain information that applicable law permits or requires us to retain.
Deletion from active systems may not result in immediate deletion from encrypted backups or systems operated independently by third-party providers.
Depending upon where you reside and which privacy laws apply, you may have rights concerning your personal information, including rights to:
confirm whether personal information is being processed and access that information;
correct inaccurate personal information;
request deletion;
obtain a portable copy of certain information;
withdraw consent where processing depends upon consent;
and opt out of certain sales, targeted advertising, or qualifying profiling where applicable.
Texas's privacy law identifies rights including access, correction, deletion, portability, and opt-out rights for certain processing when that law applies.
Minute Momentum may honor reasonable privacy requests even where a particular statutory right does not technically apply to the business.
Privacy requests may be submitted to:
hello@minutemomentum.com
Please identify the request as a Privacy Request and describe what you are requesting.
Minute Momentum may request information reasonably necessary to verify your identity and protect personal information from unauthorized disclosure or deletion.
We will respond within the period required by applicable law.
If we deny a request and applicable law provides you with a right to appeal that decision, you may submit an appeal by replying to our response or emailing:
hello@minutemomentum.com
with the subject line:
Privacy Appeal
We will process applicable appeals as required by law.
Minute Momentum is based in Texas.
The Texas Data Privacy and Security Act provides certain Texas consumers with privacy rights and imposes duties on businesses that fall within its scope. Small businesses are generally exempt from most of the Act, although the Act contains separate restrictions concerning sale of sensitive data.
Regardless of whether every provision of the Act applies to Minute Momentum at a particular point in its development, MM intends to maintain clear privacy disclosures and reasonable procedures for handling legitimate client privacy requests.
Under Texas law, sensitive data can include information revealing a physical or mental health condition or diagnosis and precise geolocation information.
Minute Momentum does not sell client health, fitness, nutrition, or coaching data.
Minute Momentum and its service providers use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or misuse.
These measures may include appropriate access controls, authentication measures, secure transmission technologies, vendor security measures, and other protections appropriate to the nature of the information and Services.
No Internet, mobile, cloud, or electronic storage system can be guaranteed to be completely secure.
You are responsible for protecting your account credentials and should notify Minute Momentum if you believe your account has been compromised.
The FTC advises businesses handling health data to maintain security appropriate to the sensitivity of the information and to understand the security practices of third-party providers on which their apps rely.
If Minute Momentum becomes aware of a security incident involving personal information, we will investigate and take reasonable steps appropriate to the circumstances.
Where applicable law requires notification to affected individuals, regulators, or other parties, Minute Momentum will provide the required notification.
Texas law includes data-security and breach-notification obligations for businesses maintaining certain sensitive personal information.
Consumer health applications outside HIPAA may also be subject to the FTC's Health Breach Notification Rule depending upon how the service operates and the information involved.
Minute Momentum is a consumer fitness and coaching business and is generally not a HIPAA-covered healthcare provider solely because clients provide health- or fitness-related information through the Services.
Accordingly, information provided directly to Minute Momentum may not receive the protections associated with HIPAA.
However, the absence of HIPAA coverage does not mean health-related information is unprotected. Other federal and state consumer-privacy, data-security, and breach-notification laws may apply.
The FTC specifically advises consumer health apps to evaluate the FTC Act and Health Breach Notification Rule even when HIPAA does not govern the service.
Nothing in this section is intended to waive protections provided by applicable law.
Minute Momentum's Services are intended primarily for adults.
A person under eighteen (18) should not establish their own coaching account unless Minute Momentum has expressly agreed to provide services with appropriate parent or legal guardian authorization.
Minute Momentum does not knowingly collect personal information directly from children under thirteen (13) without legally required parental authorization.
If we learn that information was collected from a child in violation of applicable law, we will take reasonable steps to delete or otherwise appropriately handle that information.
Minute Momentum is based in the United States, and service providers may process or store information in the United States or other countries.
If you use the Services from outside the United States, your information may be transferred to and processed in jurisdictions with privacy laws that differ from those in your location.
Where applicable law imposes requirements concerning international transfers, Minute Momentum and/or relevant service providers will use legally appropriate mechanisms.
Residents of jurisdictions that provide additional statutory privacy rights may contact Minute Momentum at hello@minutemomentum.com.
The Services may link to or integrate with websites, applications, gyms, wearable platforms, payment services, social networks, or other third parties.
Minute Momentum does not control the independent privacy practices of third parties.
You should review a third party's privacy policy before voluntarily providing information directly to that third party or connecting an optional integration.
Minute Momentum may update this Privacy Policy when reasonably necessary to reflect changes in:
the Services; technology; service providers; business operations; legal requirements; or privacy practices.
The current version will identify its effective date.
Material changes will be communicated where required by applicable law.
Where a material new use of sensitive information requires additional consent, Minute Momentum will seek that consent rather than relying solely on a revised Privacy Policy where required.
You may choose not to provide certain optional information.
However, some information is necessary for Minute Momentum to provide personalized coaching safely and effectively.
For example, if you decline to provide information reasonably necessary to evaluate exercise limitations or create an appropriate coaching plan, Minute Momentum may be unable to provide some or all requested Services.
Optional features such as certain integrations may be disabled without ending your entire coaching relationship unless that integration is necessary to the specific service you purchased.
Where Minute Momentum relies on your consent to process particular information, you may withdraw that consent prospectively by contacting:
hello@minutemomentum.com
Withdrawal does not make prior lawful processing invalid.
If the information is necessary to deliver a particular coaching service, withdrawing consent may mean Minute Momentum can no longer provide that portion of the Services.
Marketing/media consent is governed separately and may be declined without affecting your eligibility to receive ordinary coaching Services.
Clients should not send highly sensitive identifiers that Minute Momentum does not request, such as:
Social Security numbers; driver's-license numbers; passport numbers; complete payment-card numbers; card security codes; online banking passwords; or other account passwords.
If Minute Momentum needs information for a legitimate administrative reason, we will identify an appropriate method for providing it.
This Privacy Policy governs the handling of personal information.
The Minute Momentum Terms & Conditions govern use of the Services and include additional provisions concerning exercise risk, program participation, payments, intellectual property, liability, and other matters.
If the documents address different subjects, each applies to its respective subject.
